ST. LAWRENCE COUNTY, N.Y. -- The lawyer for one Amish abduction suspect said his client was also victimized.

Nicole Vaisey and Stephen Howells the second are facing two counts of first degree kidnapping with additional charges coming.

But Vaisey's lawyer, Brad Riendeau, said the two deserve different trials and punishments.

Riendeau said there's two parts to a criminal act, doing something and the state of mind while doing it.

Riendeau believes evidence pulled from the couple's Richville home shows Howells victimized Vaisey before and during the abduction.

Riendeau described the couples relationship as controlling.

"What Mr. Howells did to my client before it happened create completely different circumstances in terms out potential outcomes, potential punishments, and culpability," Riendeau said.

Vaisey is scheduled to appear in a preliminary hearing Thursday.

Riendeau said he's considering waiving that hearing as Howells has done.
