ITHACA, N.Y. -- Corbin Whyte will not get a fourth murder trial.
Whyte has gone on trial three times for the murder of Paul Garcia in 2010. Each time it has ended with a hung jury. Prosecutors were trying to prove that he shot and killed Garcia during an attempted robbery.
The last trial ended in October. Whyte was convicted on a count of tampering with physical evidence. He is still awaiting sentencing on that count, which could take place later this month.
