SYRACUSE, N.Y. -- The grand larceny charges against two brothers accused of stealing a $5 million scratch-off lottery ticket have been dismissed.

Andy Ashkar and Nayel Ashkar were accused of telling the ticket-holder it was worth only $5,000 instead of $5 million. That was in 2006 in their father's convenience store, but police say the Ashkar brothers did not actually attempt to claim the money until just last year.

An Onondaga County Court judge dismissed the attempted grand larceny charges because the statute of limitations on the alleged crime had passed. The two still face conspiracy charges.
