ITHACA, N.Y. -- After five days of deliberations, the judge has declared a mistrial in the murder trial of Corbin Whyte.

The 27-year-old Ithaca man is accused in the shooting death of 47-year-old Paul Garcia. Garcia was found dead in the parking lot of Ithaca's Maple Hill apartments in December of 2010.

Witnesses said the two men fought over drugs and Garcia's girlfriend.

Prosecutors said Whyte shot Garcia after Garcia had robbed him of drugs and money.

Whyte was charged with second degree murder, robbery and tampering with evidence. However, the jury could not come to a unanimous decision.

A new trial has been scheduled for September.
