ONONDAGA COUNTY, N.Y. -- Onondaga County District Attorney William Fitzpatrick continues to cast doubts on the story told by a third accuser in the Bernie Fine case. This time, his comments came in a question and answer exchange with readers on a Syracuse.com forum.

Fitzpatrick left little doubt in a news conference last week that he had serious doubts about the credibility of Zach Tomaselli, originally from the state's North Country, who claimed he was abused by Fine on an SU road trip to Pittsburgh in 2002. The DA said he had turned over records to Fine's attorneys involving the basketball team's travel, their hotel arrangements and Tomaselli's school attendance records for that date in the Copenhagen School District.

“I have to turn over exculpatory material. Material that tends to indicate either that the accuser is not telling the truth or that there is something beneficial to the defense. I don't turn over things other than that. And, I have turned those over to defense counsel,” Fitzpatrick said.

“Does it show he didn't travel with the team?” our reporter asked.

“Any of those questions should be referred to the United States Attorney. They're the ones that used him to get a search warrant,” Fitzpatrick replied.

Fitzpatrick said in his forum exchange that there is no evidence to support Tomaselli's claim of travel to Pittsburgh.

The DA continues to say he is not interfering with the federal probe.
